Service terms (summary)
Plain-language summary. The signed service agreement governs. Draft for attorney review before launch.
- What we do. We collect whole-building energy (and, where required, water) data, set up or update the building in ENERGY STAR Portfolio Manager, check the data, and submit the benchmarking report to each jurisdiction that requires it, on that jurisdiction's schedule. We send proof of filing.
- What we don't do. Energy audits, retro-commissioning, engineering, third-party data verification, Washington Tier 2 energy management plans, legal advice or representation, or anything that requires a licensed engineer or architect. Where a jurisdiction requires one of these (DC requires third-party verification every six years, next for the report due May 1, 2027), we can arrange a licensed partner and quote the fee before any work starts.
- Your part. Sign the utility-data authorization, give accurate building facts, and respond to data requests. The guarantee needs access at least 30 days before a deadline.
- Price and billing. Annual, paid in advance. Renews each year; we remind you 60 and 14 days before. Cancel any time before renewal.
- Guarantee. If we miss a deadline after you gave us access at least 30 days before it, we reimburse the late penalty for that deadline, up to $2,000 per building. Penalties assessed before you gave us access, and third-party verification fees, aren't covered.
- Refunds. Full refund if we can't file before the deadline for reasons on our side. No refund after filing.
- Your data. See Privacy for what we collect. You own your data. If the building is in your Portfolio Manager account, our access is a share you can revoke. If we create the record, we share it with you and transfer it to your account on request. We keep data confidential and use AI tools only under confidentiality terms.
- Limits. Our liability is limited to the fees you paid in the prior 12 months, except for the guarantee above.
- Law. Wisconsin law governs.
